A 50% non-refundable deposit is due at time of booking to secure the date/time for your session. If the payment is made by check, and the check does not clear, then a $25 Returned Check Fee will be added, and another form of payment will need to be used for future payments. The remaining 50% of your contract balance is due at the beginning of the session (unless it’s a wedding*). Cash or check made out to Emma Diaferio is the preferred method of payment at the session. For the deposit I accept cash, check, PayPal, and Venmo.
If the photographer needs to reschedule due to any reason (weather, illness, emergency, equipment malfunction) the deposit will be transferred to the next date available. If client needs to reschedule due to any reason, the cancellation must be made within 1 week in advance for the deposit to be secured and moved to a later date. If the cancellation is done with less than 1 week before the session, the deposit will be kept by the photographer and the client will need to place another deposit for any future sessions.
Sessions can vary in length depending on session type, location, props, pose combinations, client cooperation, small breaks for children, etc. While some sessions may seem a bit lengthy, the whole experience will be fun and relaxed! I try to get people as comfortable as I can and will sometimes even use prompts to get a more natural smile/reaction in my pictures.
Each session will come with a specific amount of professionally edited images. You will be able to choose your own images for me to edit (I will send you all the pictures that make the cut i.e. ones that aren’t blurred, eyes are open, etc. I will do a batch edit on them all so you can get an idea of what they will look like. I will do a complete edit on any you choose to purchase. This is different for wedding packages*). Any additional images can be purchased through the gallery to be retouched for only $10 each or 12 for $100. Additional discounts may be available if purchasing the entire gallery. No raw, original, or unedited images will be provided/released even if requested. Raw/unedited images are not true representations of our work. My hope is that when you choose me to be your photographer you are doing so because you like my style.
A password protected online gallery will be created for you. The link and password will be sent to when the pictures are done. A full album is typically complete within 4-6 weeks. During the busiest time of the year (June-September, November and December), it can take upwards of 6-8 weeks for a completed album, although all efforts are made to avoid this. The photographer will always work as quickly as possible without sacrificing quality or customer service and will always try to update you on the status of your album whenever possible. A “sneak peek” of your session is done within 48 hours of the session (typically 2 pictures are done for a sneak peek).
Any locations further than 20 miles from Brooks, Maine will require .50 cents to the mile. Also, any tolls, admission prices, an parking fees will be paid by client before pictures will be delivered.
Agreement
I understand that I should assist and cooperate with the photographer to obtain the desired photographs. The photographer is not responsible for poses not accomplished due to non-cooperation (i.e. children, alcohol, grumpy moods) and is not responsible for lack of promised pictures/length of shoot due to any non-cooperation. Every effort will be made to create the shots requested.
I give my permission to Emma Elizabeth Photography to use my images in all portfolio and marketing unless extreme privacy is requested. (If you do choose to have your images completely private, you will have an option of choosing that during the signing process). Images will be photographed and edited in the preferred style of the photographer. I agree that the style represented by Emma Elizabeth Photography through her website and Facebook page are to my liking and preference.
I understand that the photographer is not responsible for the quality of my prints I purchase elsewhere (i.e. Walgreens, Walmart quality won’t be as good of quality as pictures printed from other sources like Miller).
I understand that these photos come with full print permission, however, the copyright with these photos are still with Emma Elizabeth Photography. I do not have the legal right to crop, alter, or re-edit any of these photos and publicly share them as it may confuse potential clients of the editing style of the photographer and may tarnish the reputation of the photographer providing consistent, top quality images.
Lastly, I understand that Emma Elizabeth Photography typically keeps images on file for 1 year. After that point, it’s not guaranteed images will be available. It is important that images are backed up to multiple locations.
Wedding
*Wedding payments require the remaining 50% to be paid at least 3 months before wedding date. All wedding deposits are non-refundable. Wedding turn-around can be anywhere from 3 weeks to 6 weeks depending on package bought. However, I will of course do all that I can to make sure the pictures are delivered in an orderly time. Wedding pictures will be picked and edited by me (as opposed to other photo packages where I let you choose which ones you’d like to order). This is due to the high volume of pictures I will have.
I understand that if my wedding is over three (3) hours long, it will require a second shooter which will be $100 an hour out of my pocket (i.e. not already accounted for in the wedding package price). The second shooter will be chosen my Emma Elizabeth Photography and held to her standards.
I have read this contract in its entirety and confirm that I am at least 18 years of age. I fully understand and agree with all the information provided. I understand that if I have any questions or concerns, I can contact Emma directly for clarification.
